1. The applicant hereby applies to Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) for a credit account.*

2. Should this application be accepted by Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) the applicant agrees that the credit accounts shall be subject to the terms of this application and the usual terms and conditions of carriage.*

3. The applicant shall notify Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) of any change in the constitution or structure of the applicant or the sale of the business operation by the applicant and agrees that it shall continue to be liable to Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) for any sums outstanding on the account opened on behalf of the applicant until;*
- Written notice is received from the applicant that it has changed the constitution or structure or the sale of the business.
- Account has been closed and full payment has been received by Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP).

4. The applicant agrees that the terms and conditions applying to any credit account opened in the Name of the applicant the construction and interpretation of it shall be governed by the laws of the State of Western Australia. Regardless of any application to the contrary, the operations of the Supplier are governed by the laws of Western Australia, and any action instituted by the Supplier against the Customer, and/or any action instituted by the Customer against the Supplier, will take place under laws of Western Australia in the courts, (regardless of the amount) which are located in Perth.*

5. That all goods and/or service supplied by Industrial Demand Pty Ltd (HFP) to the Customer, on credit during any calendar month, will be paid for in full by the Customer on or before the last trading day in the following month, hereinafter referred to as “The due date”.*

6. That a monthly billing cycle will apply. In an event of any charges appearing on the account being disputed by the Customer, notice of such a dispute must be advised to Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) immediately on receipt of the Tax Invoice (account). In The event of any charges alleged to be in dispute the Customer will pay for all other charges appearing on the statement of account on or before the due date.*

7. If the amount shown to be payable on each Tax Invoice and / or statement of account is not paid to Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) on or before the Due Date such amount will be deemed to be overdue and Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) at its discretion, impose an account service fee. This service fee will be charged at the rate equivalent to the advertised compound interest rate charged by the ANZ Bank and to be compounded monthly.*

8. Any expenses, cost or disbursement incurred by Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) in recovering any outstanding monies including debt collection fees and solicitor costs shall be paid by the Customer, providing that those fees do not exceed the scale charges as charged by that debt collection agency/solicitor plus any out of pocket expenses.*

The above details are correct in every detail; we have read and understood Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) term of business; we fully understand that payment is due by the “Due Date”. We agree to be bound by the General Terms of Business contained herein” We consent to Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP) conducting a search with a credit reference Agency and contacting the credit reference shown above for the purpose of continuing a credit account with Industrial Demand Pty Ltd T/A Holdfast Fluid Power (HFP).*
